EEOC charges are not reported under an EPL (Employment Practices Liability) policy.  Under most EPL policies, whether mono-line or part of a management liability package, EEOC charges are specifically included within the definition of a Claim.

Insureds may mistakenly consider an EEOC charge as an investigation or inquiry, but the charge is required to be reported to the EPL insurer as soon as practicable, in most cases, and implicitly prior to a response to the initial EEOC or state Civil Rights Commission.

Too frequently, insureds report claims under an Employment Practices Liability policy first when the insured receives a civil suit, long after the EEOC charge has been answered and after the EEOC has disposed of the case.

At that time, it is usually too late.
